These terms are between KaiForge Digital, the trading name of Oliver Bundy of Stafford, Staffordshire ("I", "me"), and the parent group signing up ("you", "the PTA"). Whoever signs up confirms they're allowed to do so on the PTA's behalf.
1. What you get
A website for your PTA, which I host, run and keep up to date. It includes every feature described on the RunYourPTA website at the time. I set it up with your name, logo and colours, and you manage the content yourselves through the dashboard.
I'll add features and improve things over time. I might occasionally change or remove a feature. If that affects something you rely on, I'll tell you in advance.
2. Price and paying
- £20 a month, or £200 a year.
- No setup fee.
- I don't take any commission or percentage of money raised through your site, including donations, Lucky Squares and uniform sales. The price above is the only thing I charge.
- Your first month is free. Cancel before it ends and you pay nothing.
- I'm not VAT registered, so there's no VAT to add. If that changes, I'll give you 60 days' notice.
- You pay monthly (£20) or a year in advance (£200), by bank transfer or Direct Debit, whichever suits you.
- If I ever change the price, I'll give you at least 60 days' notice. If you're on the yearly plan, the new price only applies from your next renewal.
Card fees from SumUp aren't included. They're between you and SumUp.
Your site can send up to 300 emails a day (confirmations, tickets, login links and so on). If you regularly need more than that, I'll let you know, and we'll agree any extra cost before anything changes. I'll never add a charge without asking you first.
3. Cancelling
You can cancel any time by emailing me. Your site stays up until the end of the period you've paid for. On the monthly plan that's the end of the month. Paying a year in advance commits you to that year, so if you cancel partway through there's no refund for the months left, and your site stays up until the year runs out.
When your site closes, I'll send you a copy of your data, then delete it from my server, including backups. Both happen within 30 days of the site closing.
I can end the service with 3 months' notice, for example if I stop running RunYourPTA. You'd get your data back in the same way.
4. Your side
- You're responsible for what goes on your site: the words, photos and documents. Please make sure you have permission for them, including photo consent for any children shown.
- You're the data controller for the information your site collects. You'll have your own privacy notice, and deal with requests from parents about their data.
- Lotteries: if you run Lucky Squares, you need your own small society lottery registration with your local council. Running them within the law, including filing returns, is your responsibility.
- Your SumUp account is yours, under SumUp's own terms. Money goes from SumUp straight to you. I never hold or handle it.
- Keep your list of committee logins up to date, and remove people when they step down.
- Don't use the site for anything illegal, harmful, or unrelated to your PTA.
5. My side
- I'll host your site, keep the software and server updated, and back your site up every night, off the server, keeping each backup for 14 days.
- I'll help by email when you're stuck, and aim to reply within 2 working days.
- I'll process your data only to run your site, as set out in our data processing agreement, which forms part of these terms.
- I'll tell you without undue delay if I become aware of a data breach affecting your site.
6. Keeping it running
I'll do my best to keep your site up all the time, but I can't promise it will never go down. When I need to do maintenance, I'll try to do it at quiet times.
7. If something goes wrong
Nothing here limits my liability for death or personal injury caused by my negligence, for fraud, or for anything else the law doesn't allow me to limit.
Otherwise, my total liability to you in any year is limited to what you've paid me in the previous 12 months. I'm not liable for indirect losses, or for problems caused by payment providers, your email provider, or things outside my reasonable control.
8. Pausing a site
If payment is more than 30 days late, I'll remind you. If it's still not sorted 14 days after that, I may take the site offline until it is. I can also take a site offline straight away if it's being used for something illegal or is putting other sites at risk.
9. Changes to these terms
If I change these terms, I'll email you at least 30 days before the changes apply. If you're not happy with them, you can cancel.
10. The legal bit
These terms are governed by the law of England and Wales, and the courts of England and Wales can deal with any dispute. If you have a problem, please talk to me first. Most things can be sorted with an email.
